CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. Its reach extends beyond California to require any person or company in the United States operating websites that collect personally identifiable information from California consumers to post a conspicuous privacy policy stating exactly what information is collected and with whom it is shared, and to comply with that policy.

In accordance with CalOPPA, we agree to the following: users can visit our site anonymously — however, once you register to bid, you may no longer be anonymous, and the California Online Privacy Act no longer applies in that context. We will add a link to this policy on our home page or, at minimum, the first significant page after entering our website; that link includes the word “Privacy” and is easily found. Users will be notified of any changes to this policy on our Privacy Policy page, and are able to change their personal information by logging into their account.

We honor “Do Not Track” (DNT) signals and do not track, plant cookies, or use advertising when a DNT browser mechanism is in place. If you enable Do Not Track, some features may be disabled, and it may affect your site experience or the functioning of some services.

When it comes to the collection of personal information from children under 13, COPPA puts parents in control. The Federal Trade Commission enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

We do not knowingly collect personally identifiable information from anyone under the age of 18. The Fair Information Practice Principles form the backbone of privacy law in the United States and have played a significant role in the development of data protection laws globally. Understanding and implementing these principles is critical to compliance with the various laws that protect personal information.

In line with Fair Information Practices, should a data breach occur we will notify affected users via email and via in-site notification, each within one business day.

We also agree to the Individual Redress Principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law — including recourse to courts or government agencies to investigate and/or prosecute non-compliance.

The CAN-SPAM Act sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped, and spells out penalties for violations.

We collect your email address in order to: send information, respond to inquiries and other requests or questions; process purchases and send related information and updates; send additional information related to your purchases and/or our services; and market to our mailing list or continue to send emails to clients after the original transaction.

In accordance with CAN-SPAM, we agree to: not use false or misleading subjects or email addresses; identify each message as an advertisement in some reasonable way; include our physical business address; monitor any third-party email marketing service for compliance; honor opt-out/unsubscribe requests quickly; and allow users to unsubscribe via the link at the bottom of every email.

If you are part of the probate process, all of your data is considered public information and is therefore not subject to this act.

If at any time you would like to unsubscribe from future emails, follow the instructions at the bottom of each email and we will promptly remove you from all correspondence.

Disclosure for law enforcement.
